Terms of Use — Messages - Texting SMS App

1. The agreement and how it changes

These Terms of Use are a contract between you and Mobile Clean System Lab, publishing as Mobile Clean System Lab, for use of Messages - Texting SMS App. Our address is Central Plaza, 18 Harbour Road, Wan Chai, Hong Kong, Hong Kong SAR.

We may update these Terms. If a change materially reduces your rights, we will give at least 15 days’ notice in-app or on this page where practicable. Continued use after the effective date means you accept the updated Terms.

2. Who may use the App

You must be at least 13 years old, or the higher age required in your country, and able to form a binding contract. If you use the App for an organisation, you confirm you can bind that organisation.

3. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App for its intended purpose, subject to these Terms and the App Store or Google Play rules that apply to your download.

4. Acceptable use

You agree not to: probe or attack our systems; reverse engineer except where mandatory law allows; distribute malware; spam; infringe others’ rights; misuse permissions; or break applicable law. We may suspend access for serious breaches.

5. Our intellectual property

The App, branding and related materials remain owned by Mobile Clean System Lab or our licensors. These Terms do not transfer ownership to you.

6. Purchases, subscriptions and refunds

In-app purchases and subscriptions are sold by Apple (App Store) or Google (Google Play) as the seller of record for that platform. Prices, renewal periods and taxes are shown in the store purchase flow. Subscriptions renew unless you cancel in App Store subscriptions or Google Play Payments & subscriptions as required by that store before renewal.

Refunds follow the applicable store policy (including any early refund windows) and mandatory consumer law. We do not state “no refunds” in all cases. After the store’s self-serve window, contact [email protected] with your order number.

7. If you are a consumer in the EEA, the UK or Switzerland

Nothing in these Terms limits mandatory consumer rights. Digital content may affect withdrawal rights when you consent to immediate supply and acknowledge loss of withdrawal where the law allows. Disputes may be brought in your country of residence where mandatory rules say so.

8. Advertising

Free versions may show ads, including personalised ads where allowed. Details and choices are in the Privacy Policy.

9. Third-party services

The App may link to or rely on third-party services (including Google). Their terms and privacy notices apply to their services. We are not responsible for third-party content we do not control.

10. Availability, updates and ending the agreement

We may update, change or discontinue features. You may stop using the App at any time by uninstalling it and cancelling subscriptions in the App Store or Google Play. We may end the licence for material breach or legal risk.

11. Disclaimers

THE APP AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND TO THE FULLEST EXTENT PERMITTED BY LAW.

12. Limitation of liability

To the fullest extent permitted by law, Mobile Clean System Lab is not liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data. Our total aggregate liability for claims relating to the App is limited to the greater of USD 50 or the amounts you paid for the App via the App Store or Google Play in the 6 months before the claim. Mandatory consumer rights remain unaffected.

13. Indemnity

You will defend and indemnify Mobile Clean System Lab against third-party claims arising from your misuse of the App or your breach of these Terms, to the extent permitted by law.

14. Governing law and disputes

These Terms are governed by the laws of Hong Kong SAR, without prejudice to mandatory consumer protections in your country of residence. Courts of Hong Kong have non-exclusive jurisdiction, except where consumers may sue in their home courts.

15. Copyright complaints

Send copyright notices to [email protected] with your contact details, a description of the work, the allegedly infringing material, and a good-faith statement. We may remove content or disable access where appropriate.

16. App Store and Google Play

If you downloaded the App from the App Store, your use also remains subject to Apple’s Licensed Application End User License Agreement and related App Store terms. If you downloaded it from Google Play, your use remains subject to the Google Play Terms of Service. Apple or Google may have rights as a third-party beneficiary of certain licence terms as described by that platform.

17. General

If a clause is unenforceable, the rest remains in force. These Terms are the entire agreement for the App. The English version controls if translations differ. We may assign these Terms in connection with a reorganisation or sale.
